The cost of making a Testamentary Trust Will is higher as company and trust structures need to be examined and the Will drafted carefully to ensure flow through all trust structures as intended. We provide fee estimates for Testamentary Trust Wills at the first appointment once we know what structures you have.

Cost of an Urgent Will - Single

Instructions taken at hospital or bedside. Will prepared immediately and second visit for signing.

(An Enduring Power of Attorney not included when we prepare an Urgent Will.)

Cost of Making a Will - Standard Wills with Complex Provisions

An extra fee of $220 applies when a complex provision needs to be advised upon and drafted. 

Circumstances where a complex provision may be required:

  • providing for a former spouse
  • providing for stepchildren
  • providing for estranged children
  • you wish to specifically leave someone out of your will (who would normally be included)
  • a beneficiary lives overseas
  • a beneficiary has a disability or is unlikely to be able to manage their inheritance
  • you have assets overseas

There will be no surprises about the cost of making a Will. Your lawyer will advise you about costs of making a will before any drafting begins.

Assets -  multiple entities, more than one company and trust; a Business which is a company with a shareholder agreement and a SMSF; Detailed gifts to specific family members; Detailed arrangements for gifts in your blended family.

Information about Costs of Making a Will

  • All prices include gst. 
  • When we prepare your Will, we will prepare you an Enduring Power of Attorney (EPA) for FREE.
  • We provide copies of documents to you and Safe Custody storage for your originals for FREE
  • Call us and we will review your will with you every 5 years for FREE
  • Will preparation requires a minimum of 2 'face-to-face' appointments. These are included in the fee
  • We will confirm the cost of a Will and Power of Attorney at your first appointment. If you proceed, once payment of fees is made to our Trust Account, we will commence drafting documents. Once settled, a final appointment is made for signing
  • If we are preparing a Testamentary Trust Will - we prepare a Costs Agreement which sets out the estimate of the cost of a Testamentary Trust Will
  • As we advise on all aspects of estate planning, we will recommend other estate planning documents such as EPA's and Super Binding Death Benefit Nominations.
Cost of Estate Planning Documents

Enduring Power of Attorney (EPAs) - $440 for a single. $660 for couples (2 EPAs).

Advance Health Directives – from $330.

Superannuation Binding Death Benefit Nomination  - $220 per Industry Fund.

Customised Nomination (SMSF): $550 - $880 depending on preparation time.

If you have a SMSF, a Customised Nomination will need to be prepared. A Customised Nomination requires the lawyer to examine the company/trust documents that have established your SMSF and prepare a Binding Death Benefit Nomination Form that complies with the relevant laws (unlike an industry fund where a form is provided). If 2 are needed (and if a couple and same SMSF) – a fee of $220 applies for the 2nd Nomination.


Hourly Rates of our Wills & Probate Lawyers

Hourly rates may apply if work is outside the scope of the fixed fee (eg. for time taken to administer an estate - or to prepare a complex and detailed testamentary trust will.)

Hourly Rate for a Senior Associate Wills/Estate Lawyer: $450 + gst.
