Wills & Estates

We have helped many people over the years with Wills and Estate matters.

As lawyers in Townsville, we would love to help you too. Ivan Baxter has over 25 years of experience drafting wills, enduring power of attorney documents and administering Estates for the families of people who have passed away. Ivan Baxter, Georgina Paterson and Cathy Fon are available to speak with you over the phone or to discuss what needs to be done in person. Occasionally, illness precludes a person from coming into the office to make a Will. We are always available to come and see you and help you with your will and estate planning in Townsville.

We have vast experienced in the drafting of Wills and the Administering of Estates. We can also advise on the rights of disappointed family members or beneficiaries who wish to challenge a will.

Our fees are very reasonable. We are happy to give you an indication of price over the phone. We can give you a better idea of costs when you come in to discuss your Will with us and we know more details about your situation.

Free Review Service to Existing Clients.

We offer all of our ‘Wills and EPA’ clients a free review service every 3-5 years as we think it’s important to check that your Will and Enduring Power of Attorney always reflects your wishes. You may feel sure there is no need for review and that’s great. We encourage people who are uncertain, to make an appointment to discuss their will. If you decide that changes are not necessary, there is no charge for this appointment.

If, however, your Will and/or Power of Attorney documents do need updating, we are available to do this for a reduced fee that is 25% off our usual price.

On top of that, we provide a free safe custody service where your original documents like your Will and EPA are kept in a fire-proof safe at our office.

Making Difficult Times Easier

We always encourage people to make a Will and to appoint an Enduring Power of Attorney. It is very important to obtain legal advice in the making of a Will. It is a wise and kind thing to do for your family as it provides clarity and certainty in a difficult time and reduces the likelihood of a dispute after you are gone.

We can advise and assist with:

  • Wills
  • Estate Planning
  • Testamentary Trusts
  • Enduring Power of Attorney
  • Administration of an Estate
  • Probate and Letters of Administration
  • Estate Dispute Resolution

Legal Wills in Townsville

Most people wish to make sure their family is cared for financially, even after their passing. Having a Will carefully drafted by a lawyer, is a step in the right direction. A correctly drafted Will, ensures that you provide for the people you care about and that you leave your property to the beneficiaries you intend. Beneficiaries usually include a spouse, a defacto spouse,  children, family members and sometimes, charitable organisations.

A Will also sets out who the executor is. The executor is the person who oversees and carries out the wishes set out in the Will (sometimes with the help of a lawyer). Once this is set up, you can rest assured that your wishes will be followed to the letter when you are no longer around.

We have attached some information that sets out information about Wills. Please download the document and have a read. We are available to explain things further in an appointment.

Hiring an Estate Planning Lawyer in Townsville

Although it includes the preparation of a valid Will, effective estate planning goes far beyond one single document. An estate plan gives you the opportunity to:

  • nominate someone to act on your behalf if you become unable to make your own decisions
  • decide whether your superannuation assets and insurance will be included in your estate
  • use trusts or other structures to protect your assets and gain tax benefits
  • protect vulnerable family members
  • specify arrangements for the smooth transfer of your business interests.

Estate planning documents (including Wills, powers of attorney, powers of guardianship, insurance and superannuation nominations and Testamentary Trusts) are the tools that are used to implement the strategies that are developed as part of the estate planning process. It is important to have a lawyer who is experienced to advise you on what is best for your situation.
